Oregon Law

The Oregon legislature passed a statute to protect vulnerable people in our community from abuse. ORS 124.100 protects everyone 65 and older, as well as people who are incapacitated from physical or mental impairment or incapable of making their own financial decisions.

We Fight to Protect Vulnerable Adults

In the Herring v. American Medical Response case our firm handled, the Oregon Supreme Court of Appeals confirmed that a person can be temporarily incapacitated by, for example, unconsciousness, being under anesthesia or illness.

The law provides a seven-year statute of limitations to bring a claim. It entitles the victim to triple damages and attorney fees if they prevail.
