Lawsuit filed against Eugene tavern after a deadly drunk driving incident

An intoxicated Oregon woman left a Eugene tavern, got behind the wheels of her car, and committed a deadly hit-and-run. K&M has filed a wrongful death lawsuit on behalf of the victim’s estate.

On the night of the accident, Daniel Ortiz-Reynaga and his son Julio Ortiz walked across a Springfield street and were hit by Isabel McDaniel’s car. Julio Ortiz was slightly injured from the accident, but Ortiz-Reynaga hit the windshield and was thrown into the luggage rack on top of McDaniel’s car. McDaniel drove eleven blocks before stopping her car, getting out, and pulling Ortiz-Reynaga onto the street. McDaniel later contacted her husband who helped her wash blood off of the car’s roof and side panels. Her husband also tried to hide the car with a trailer. McDaniel’s husband was cited with evidence tampering.

In Jan. 2016, McDaniel pleaded guilty to eight charges, including driving while under the influence of intoxicants and criminally negligent homicide.

In 2015, The Keg was involved in another alcohol-involved vehicle fatality. After leaving The Keg, Richard Charleston crashed his motorcycle near their parking lot. Charleston walked away from the crash, but his passenger fell out of the passenger-car and died. Charleston was charged with hit-and-run, driving under the influence of intoxicants, and second-degree manslaughter.

K&M has filed a lawsuit on behalf of Ortiz-Reynaga’s estate, claiming that McDaniel and The Keg tavern are liable for the wrongful death of Ortiz-Reynaga. In the lawsuit, K&M’s Mark McDougal said “criminal charges are never brought against the bars in these situations” but that “one might conclude McDaniel was overserved” based on her actions.

Ortiz-Reynaga’s estate is seeking $3.9 million for their wrongful death claim.
